ELIGIBILITY: The Nissan NEXT 2013 Nissan Pathfinder Giveaway (the “Sweepstakes”) is open only to legal US residents physically residing in the 50 United States (including the District of Columbia) who are 18 years of age or older at the time of entry. Employees of Nissan North America, Inc., (“Nissan,” or “Sponsor”), GMR Marketing LLC (“GMR”), TBWA/Chiat/Day, and their respective parent companies, affiliates, dealerships, promotion and other vendor agencies involved in this Sweepstakes, as well as the immediate family members (spouse, parents, siblings and children) and household members of each such employee, are not eligible to enter or win. Void where prohibited or restricted by law. Sweepstakes is subject to all applicable federal, state, and local laws and regulations.
HOW TO ENTER: Two (2) ways to enter: 1) On-site Electronic Entry: To enter the Nissan NEXT 2013 Nissan Pathfinder Giveaway, visit a participating Nissan NEXT Mobile Innovation Center Tour Event (“Tour Event”) between October 19, 2012 and February 17, 2013 (the “Promotion Period”). For a complete list of Tour Events, visit www.nissannext.com. To enter, complete an Official Electronic Entry Form during hours of Tour Event operation, including first and last name, address (No P.O. Boxes accepted), city, state, zip code, daytime phone, e-mail address, verify age eligibility and accept the Official Rules and Sponsor’s Privacy Policy and click “Submit” during the Promotion Period. Administrator’s computer will be the official time clock for the Sweepstakes. Any attempt at e-mail or Internet entry is void. Any attempt by any person to obtain more than the stated number of entries by using multiple/different email accounts, or any other methods will void all of that person’s entries and that person will be disqualified. 2) Mail-in Entry: To enter the Nissan NEXT 2013 Nissan Pathfinder Giveaway via the mail-in option, print your first and last name, address including city, state, and zip code (no P.O. Boxes accepted), daytime phone number, age, e-mail address, and Nissan NEXT 2013 Nissan Pathfinder Giveaway Mail-in Entry on a 3” x 5” card and mail it in a stamped business envelope to: Nissan NEXT 2013 Nissan Pathfinder Giveaway Entry, P.O. Box #511138, New Berlin, WI 53151. Sponsor is not responsible for lost, late, incomplete, inaccurate, misdirected, unintelligible, postage-due, or returned entries. All mail-in entries must be postmarked by February 17, 2013 and received by February 25, 2013. Limit one (1) entry per person/authorized e-mail account holder during the Promotion Period regardless of entry method.
PRIZE AND APPROXIMATE RETAIL VALUE:
One (1) Grand Prize: 2013 Nissan Pathfinder SL 4WD, 3.5 Liter V6, with Crossbars and Floor mats. Vehicle package,interior and exterior colors to be selected solely by the Sponsor. Grand Prize does NOT include as part of the prize vehicle options, taxes, fees, title costs, registration, and insurance, all of which are winner’s sole responsibility. Vehicle awarded to a California, Massachusetts, New York, or Vermont resident will include required emissions equipment. Grand Prize will be titled to winner (or to parent or legal guardian if winner is under the age of majority in state of residence). Grand Prize winner (or a person designated by the Grand Prize winner) must have a valid driver’s license, and satisfy applicable proof-of-insurance laws to take delivery of Prize; and must take delivery at a location reasonably designated by the Sponsor. The Sponsor will not provide any additional verbal or written warranties other than the standard written warranty statement provided with the vehicle. Approximate Retail Value (“ARV”): $36,570. The Grand Prize winner will also receive a single cash payment of $18,839.09 in the form of a corporate check, which is intended to assist with any federal or state obligations related to the prize as well as any additional fees, etc. Total ARV of the Grand Prize is $ 55,409.09.
No substitution or transfer of prize is allowed except that Sponsor reserves the right to substitute prize of the same approximate retail value. Prize consists only of items specifically listed as part of the prize. No cash substitutions will be allowed. All federal, state and local taxes related to the prize are the sole responsibility of the winner. Odds of winning depend on the number of eligible entries received.
PRIZE WINNER SELECTION AND NOTIFICATION: The Potential Grand Prize winner will be selected in a random drawing on or about March 11, 2013. in accordance with these Official Rules on Sponsor’s behalf by GMR, an independent organization. The Potential Grand Prize winner will be notified by phone or e-mail to the phone number/ e-mail address indicated on the entry form on or about March 14, 2013. If any notification or prize is returned as undeliverable, original winner will forfeit prize in its entirety and an alternate winner will be selected. Potential Grand Prize winner (or parent or legal guardian if winner is under the age of majority in state of residence) will be required to complete, have notarized, and return an affidavit of eligibility, mutually-agreeable liability release, publicity release, and any other necessary documents, including required tax documents within seven (7) calendar days after notice is received or the prize will be forfeited in its entirety and an alternate winner may be selected, time permitting. Award of prize and confirmation of winner is contingent upon potential winner’s qualification and compliance with Official Rules. An alternate winner, if needed, may be selected in a similar random drawing from among the remaining eligible entries, time permitting. The Grand Prize will be fulfilled approximately 8-10 weeks following winner confirmation. If any prize is returned as undeliverable, original winner will forfeit prize in its entirety and an alternate winner may be selected, time permitting.
ADDITIONAL RULES: By entering the Sweepstakes, participants release and hold harmless Sponsor, GMR, TBWA/Chiat/Day, and their respective parent companies, subsidiaries, affiliates, directors, officers, employees, and agents from any and all liability for any injuries, loss, or damage of any kind arising from or in connection with this Sweepstakes or any prize won, including any injuries, loss or damage of any kind arising from or in connection with participation in the Sweepstakes. By entering, entrant agrees to be notified using the e-mail address or daytime phone number provided on the entrant’s Official Electronic Entry Form or Mail-in Entry by the Sponsor and/or GMR for purposes of administration of this Sweepstakes. Sponsor is not responsible for any typographical or other error in the printing of this offer, administration of the Sweepstakes or in the announcement of prizes. In the event Sponsor is prevented from continuing with this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, or other cause not reasonably within Sponsor’s control (each a “Force Majeure” event or occurrence), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel, or terminate the Sweepstakes without further obligation and, if so, Sponsor reserves the right, but not the obligation, to award the prize from among all valid and eligible entries received up to the time of such Force Majeure event. All entries are the property of Sponsor and are not returnable.
ELECTRONIC REGISTRATION: This Sweepstakes is intended for viewing in the United States only and shall be construed and evaluated according to U.S. law. Do not enter this Sweepstakes if you are not located in the 50 United States or if you are not a legal U.S. resident. If for any reason, the computerized entry portion of the program is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other cause beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Sweepstakes, Sponsor reserves the right at its sole discretion to disqualify any individual who tampers with the entry process and to cancel, terminate, modify, or suspend the Sweepstakes. Each entry must be manually key-stroked and manually entered by the individual participant. Repetitive automated electronic submission of entries is specifically prohibited, and any such entries will be disqualified. Entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. In the event of a dispute, the potential winner may be required to provide proof that he/she is the authorized account holder of the identified e-mail account, and Sponsor’s decision will be final. Sponsor is not responsible for any problem or technical malfunction of any computer equipment or software that results in loss of entry. WARNING: ANY ATTEMPT BY ANY PERSON TO DELIBERATELY DAMAGE ANY COMPUTERIZED SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGE FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
